“ST-SENATORS” CONTEST Rules

 


Official Rules
(the “Rules”)

 

1. CONTEST AND CONTEST PERIOD

The “ST-SENATORS” Contest (the “Contest”) is held by Les Rôtisseries St-Hubert Ltée (the “Organizer”). The Contest begins on Monday, February 20, 2023, at 11 h 00 min 01 sec Eastern Time (ET) and ends on Thursday, April 13, 2023 at 23 h 59 min 59 sec ET (the “Contest Period”). The clock used by the Organizer will be the official clock to determine the date and time of receipt of an Entry (as such term is defined below).
 

2. ELIGIBILITY

The persons who are eligible to participate in the Contest are those who meet the following criteria at the time of entering the Contest: they are legal residents of Canada and have reached the legal age of majority in their province or territory of residence (a “Participant” or, collectively, the “Participants”).

Are excluded the employees, officers, directors, shareholders, agents, representatives or mandataries of the Organizer and those of its subsidiaries, related companies, franchisees, affiliates, advertising and promotional agencies and suppliers of prizes, as well as the members of their immediate family (father, mother, sisters, brothers, children), legal or common-law spouse, and all individuals with whom these individuals are domiciled, whether or not these persons are related to each other.
 

3. HOW TO PARTICIPATE

To participate in the Contest, the Participant must go to the website st-hubert.com/st-senators (the “Contest Website”). The Participant must then complete all the following steps to participate in the Contest:

a. During the Contest Period, the Participant must:
purchase a St-Hubert product in the dining area, at the take-out counter, in the drive-thru, or through delivery at one of the Participating St-Hubert Rotisseries identified in Schedule A (a “Purchase”). Then, the Participant must submit with his or her Contest entry the 7-digit invoice number indicated on his or her Purchase receipt;

in the space reserved for this purpose on the Contest Website, explain in three hundred (300) words his or her interest in the Contest and the Organizer and why St-Hubert and the Ottawa Senators are the perfect match. The text submitted must be original (not copied) and must not violate any applicable laws, including applicable intellectual property laws. A Participant may not submit the same text more than once during the Contest Period.

b. The Participant must fill out all mandatory fields of the participation form, including, among others, his or her first name, last name, date of birth, telephone number, email address, city, province, postal code, Participating St-Hubert Rotisserie where the Purchase was made, and must confirm having read and accepted the conditions and Rules of the Contest.

c. By participating in the Contest, the Participant agrees to comply with these Rules and with the Organizer’s Privacy Policy available at the following link: https://st-hubert.com/en/privacy.html

d. By clicking on "submit", the Participant will obtain one participation in the Contest ("Entry"). Maximum of one (1) Entry per Day per person (a "Day" is a standard calendar day)

In order to obtain one (1) additional Entry, the Participant will have the possibility to subscribe to St-Hubert’s newsletter. This additional Entry can only be effected once by the Participant during the Contest Period, irrespective of the email address used.

LIMIT: For the entire Contest Period, the maximum number of Entries per Participant is (i) one (1) Entry per Day, for a total of fifty-three (53) Entries; and (ii) one (1) additional Entry by subscribing to St-Hubert’s newsletter. Each Entry is valid only for the ongoing Draw.

The Participant must submit each Entry personally. The Participant may only use one (1) email address for this Contest. Mechanically reproduced, forged, or altered Entries are void. The Organizer is not responsible for lost, late, undelivered or invalid Entries, which will be disqualified. All Entries become the exclusive property of the Organizer and will not be returned to you.

Any attempt by a Participant to obtain more than the stated number of Entries by using multiple email addresses, social media accounts, identities, registrations, logins, or any other methods will void that Participant’s Entries and that Participant may be disqualified at the Organizer’s sole discretion. Use of any automated system (including but not limited to, Entries submitted using any robot, script, macro, or other automated service) to participate is prohibited and will result in the disqualification of the Participant. In the event of a dispute as to the identity of any person who submitted an Entry, the authorized account holder of the email address will be deemed to be the Participant. The “authorized account holder” is the natural person assigned to the email address by the internet access provider, the online service provider or other organization responsible for assigning the email address account. Selected Participants may be required to show proof of being the authorized account holder.
 

4. THE PRIZES

There is a total of nine (9) Prizes available as part of the Contest. The total approximate retail value of the Prizes is twelve thousand three hundred and sixty dollars ($12 360 CAD). Each Prize consists of a gift set of a total approximate retail value of one thousand three hundred and seventy-three dollars ($1 373 CAD) each, comprising:

- Four (4) tickets to an Ottawa Senators home game at the Canadian Tire Centre in Ottawa (ARV: $340);

- Four (4) Ottawa Senators official jerseys (ARV: $833);

- One (1) St-Hubert gift card of a value of $200..

The approximate retail value of the Prizes is in Canadian dollars and includes the amount of GST and QST applicable taxes. A Participant may win a maximum of one (1) gift set during the Contest Period.

Remarks regarding the jerseys:The selection of the Ottawa Senators’ jerseys will be at the discretion of the Organizer and of “CSEI” (Capital Sports & Entertainment Inc.). The Winners will be able to choose the size of their official jersey.

Remarks regarding the hockey tickets: The dates of the hockey games related to the Prizes are at the discretion of the Organizer. The tentative date of the hockey tickets included in the Prizes awarded pursuant to the February 27 and April 3, 2023 Draws is April 10, 2023. The tentative dates of the hockey tickets included in the Prizes awarded pursuant to the April 10 and April 17, 2023 Draws will be during the 2023-2024 hockey season. The hockey tickets are valid only for the hockey game on the date selected by the Organizer and CSEI. The precise seats of the tickets are at the discretion of the Organizer, who cannot guarantee contiguous seating. Meals, beverages, transportation, parking, and all other expenses are the responsibility of the Winner and their guest(s). Once the Organizer announces the dates of the Ottawa Senators hockey games, the Organizer reserves the right to change the dates at its discretion. No requests for date changes or ticket exchanges will be accommodated. The Organizer assumes no responsibility for the cancellation, delay, suspension, or postponement of the hockey games. The Participant acknowledges that the course of the game is beyond the control of the Organizer. The Winners and their guests are solely responsible for complying with all health and vaccination requirements in effect at the time of the hockey game. If a Winner and/or their guest(s) are denied admission to the hockey game because they do not meet the health and vaccination requirements, no monetary compensation will be provided by the Organizer.

Remarks regarding the St-Hubert gift cards: The use of St-Hubert gift cards is subject to the terms and conditions of said gift cards.

The gift sets are individually referred to as the “Prize” or collectively as the “Prizes”.

A Prize must be accepted as it is described in these Rules and cannot, under any circumstances, be, in whole or in part, transferred to another person. The Winner will not be entitled to the difference, if any, between the approximate value of a Prize and the real value. If a portion of the Prize is not used, in whole or in part, no monetary compensation will be provided.

At any time and for any reason whatsoever, the Organizer reserves the right to substitute, in whole or in part, a Prize as described in these Rules with a prize of the same nature and of equivalent or greater monetary value, or, in its sole discretion, to provide the monetary value of a Prize (or of a component of a Prize), as indicated in these Rules.

The Prizes will comply with the present Rules but may differ from the photos used in the Contest advertisement or promotional materials. To the fullest extent permitted by applicable laws, the Organizer makes no representations and offers no guarantees, express or implied, with respect to the quality or value of any Prize offered pursuant to the Contest.
 

5. SELECTION

There will be eight (8) draws during the Contest Period, each a “Draw” and collectively, the “Draws, which will occur once a week in accordance with the “Draw Schedule” reproduced below. For each Draw, Entries must be submitted before 23 h 59 min 59 sec ET of the “Closing Date”.

Each Draw will take place at around 14 h 00 ET at the offices of Organizer, located at 1755, boul. Lionel Bertrand, Boisbriand (Québec) J7H 1N8.

During the draws occurring between February 27 and March 27, 2023 and those occurring on April 10, 2023 and April 17, 2023, one (1) Entry will be randomly selected amongst all eligible Entries received before the Closing Date of each Draw. 

During the Draw occurring on April 3, 2023, two (2) Entries will be randomly selected amongst all eligible Entries received before the Closing Date of the Draw. A total of nine (9) Entries will be selected during the Contest Period. The odds of winning a Prize depend on the number of eligible Entries received before the Closing Date of each Draw.

6. PRIZE AWARD

The Organizer will contact the Participant(s) elected during a Draw within the forty-eight (48) hours following the Draw, by email or by telephone (information provided at the time of his or her participation).

The selected Participant must then respond to the Organizer at the latest within forty-eight (48) hours following the Organizer’s abovementioned notice, in accordance with the instructions provided by the Organizer.

If the Organizer cannot contact the selected Participant or if the selected Participant does not respond to the Organizer within the aforementioned delay, for whatever reason, the Organizer reserves the right, in its sole discretion, to proceed to another Draw in order to try to award the Prize to another Participant, which will be subject to disqualification in the same manner. The Organizer cannot, under any circumstances, be held to award a number of prizes that is greater than what is provided in these Rules.

To be declared winner (a “Winner”), each selected Participant must satisfy the Contest admissibility criteria and comply with the present Rules as well as with the following requirements:

a) Sign a “Release” with regards to the Prize and confirm having read the present Rules and undertake to comply with such Rules. The Release must be returned to the Organizer within the forty-eight (48) hours following its sending to the selected Participant or within a delay otherwise stipulated by the Organizer;

b) Correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question administrated by phone at a mutually acceptable moment;

c) the Selected participant’s guests will also be required to sign the Release. If a guest is under the age of majority in his or her province or territory of residence, the Release must be signed by the guest’s parent or legal guardian; and

d) If requested by the Organizer, provide an identification document with a photograph.

If the selected Participant cannot meet all these requirements, he or she cannot be declared the winner of a Prize and the Organizer will apply the procedure to reselect a Participant, who will be subject to disqualification in the same manner. The Release is subject to review by the Organizer. Any Release that is, as the case may be, incomplete, illegible or submitted late may be refused.

The Winner will receive his or her Prize by mail, at the address indicated on the Release, within the twenty (20) working days following the receipt of the Release by the Organizer.

The Prize must be accepted as it is described in these Rules and cannot, under any circumstances, be, in whole or in part, transferred to another person, substituted for another Prize or exchanged for money, subject to what is expressly provided in these Rules.

At any time and for any reason whatsoever, the Organizer reserves the right to substitute a Prize as described in these Rules, or any component thereof, with a prize of the same nature and of equivalent or greater monetary value, or, in its sole discretion, to provide the monetary value of the Prize or of a component of the Prize, as indicated in these Rules.
 

7. GENERAL CONDITIONS 

7.1 Personal Information. The Organizer and its authorized agents will collect, use, and disclose the personal information provided by the Participants at the time of Entry into the Contest for the purposes of administering the Contest and for the fulfillment of the Prizes. Each of the Winners consent to the Organizer’s use of his or her name, photograph, city, voice, images and/or declarations relating to his or her Prize for publicity purposes, in any media now known or hereafter developed, including on the Internet, at any time, in perpetuity, and this without any form of compensation or notice. The possibility to receive other communications about the Organizer’s products, contests and other promotional offers may be provided by the Organizer. No communication, whether of commercial or other nature, unrelated to this Contest will be sent to the Participant, unless he or she has otherwise consented thereto, subject to the provisions of the applicable law. 7.2 Conduct of the Contest and disqualification. The Organizer reserves the right, in its sole discretion, to cancel a Participant’s participation form or to disqualify a Participant from the Contest and/or to exclude the Participant from any other future contest or promotion held by the Organizer 1) if the Participant fails to respect each of the conditions set out in these Rules; 2) if the Participant participates or attempts to participate in this Contest by using means that are contrary to these Rules or that are unfair towards the other Participants; or 3) if the Participant is suspected of having i) tampered directly or indirectly with the conduct of the Contest, ii) made a false statement regarding his or her participation, or iii) violated these Rules. Any attempt to deliberately damage any component related to the participation in or administration of the Contest or to sabotage the legitimate conduct of the Contest constitutes a violation of civil and criminal laws. If such attempts were made, the Organizer reserves the right to deliver the Participant or any other person directly or indirectly related thereto to the competent judicial authorities and to obtain compensation under the law. The Organizer's decisions regarding any aspect of the Contest are final. The Contest is subject to all applicable federal, provincial and municipal laws. The invalidity or unenforceability of one of the provisions of these Rules does not affect the validity or enforceability of any other provision contained herein. If any provision of the Rules is found to be invalid or otherwise unenforceable, these Rules will remain in effect and should be interpreted as if the non-applicable provision were not part of the present Rules. Paragraph headings are used for reference purposes only and should not affect the interpretation of the Rules.

7.3 Limitation of liability. By participating in the Contest, the Participants agree to release the Organizer, the Ottawa Senators (CSEI), the National Hockey League and the teams that are part of it, NHL Enterprises Canada L.P. and their subsidiaries, affiliated companies, advertising agencies, licensees, franchisees, partners, retailers, distributors and all other stakeholders related to the Contest as well as their respective directors, administrators, shareholders, employees, agents, representatives, successors and assigns (collectively the "Releasees") from any obligation and liability due to the Participant’s participation in the Contest or to an attempt to participate in the Contest, including, without limitation:

- By participating in the Contest, the Participants agree to release the Releasees from any obligation and responsibility with regard to any damage or loss caused by any technical problem or defect likely to disrupt the Contest or the conduct thereof, and arising in particular, but not limited to, the malfunction of any computer component, any software or any communication line, the loss or absence of network communication or any faulty, incomplete or deleted transmission or download by any computer or any network. The Organizer in no way guarantees that all of the components related to the participation in and the administration of the Contest, including the Contest Website or any site related thereto, if applicable, will be accessible or functional without interruption during the Contest Period or that they will be free from any errors. The use of any component related to the participation in and the administration of the Contest is made at the risk of the Participant. By participating in the Contest, the Participants agree to release the Releasees from any responsibility with regards to human, typographical, technical or computer errors, printing or network errors which may occur in the context of the administration of the Contest, of the download, of the counting or of the processing of the participation forms, of the announcement of Prizes or in the documents related to the Contest.

- By participating in the Contest, the Participants agree to release the Releasees from any claim, action, damage, demand, means of action, cause of action, lawsuit, debt, duty, account, surety, agreement, guarantee, indemnity, contract or liability of any kind whatsoever, arising out of or related to the Participation or the attempt to participate in the Contest, including, but not limited to, for the participation forms, the participation emails without purchase or any lost, incomplete, late, or misdirected liability Releases.

- By accepting a Prize, each Winner and each guest releases the Releasees from any responsibility, any obligation, any claim, action, damage, demand, means of action, cause of action, lawsuit, debt, duty, account, surety, agreement, warranty, indemnity, contract or liability of any kind whatsoever arising from or related to the acceptance and/or use of the Prize, including, without limitation, any injury, death or damage to property or loss of property. Each Winner and each guest acknowledges that, as of the awarding of the Prize, the obligations linked thereto become the responsibility of the providers of the services and products comprised in the Prize, within the limits of applicable law.

7.4 Trademarks. OTTAWA SENATORS and related logos are registered/filed trademarks owned by CSEI and remaining its property. These trademarks are used by the Organizer under authorization. The Organizer is not affiliated with CSEI. CSEI acts solely as a Prize provider and CSEI, including its parent companies, subsidiaries, establishments and other operating entities, have not authorized, sponsored or endorsed this Contest.

7.5 Modification of the Contest. The Organizer reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest, in whole or in part, without notice or obligation, in the event that any occurrence or any human intervention manifested that could alter or influence the administration, security, impartiality or conduct of the Contest as provided for in these Rules, and this, subject to the approval of the Régie des alcools, des courses et des jeux (“Régie”) in Quebec, if required.

7.6 End of participation in the Contest. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including, but not limited to, due to a computer virus or bug, to tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, according to the Organizer, in its sole discretion, corrupt or affect the administration, security, fairness, integrity or normal conduct of the Contest, the Organizer may, in its sole discretion, and subject only to the approval of the Régie for the residents of Quebec, cancel any suspect Entry and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to solve the problem, and then resume the Contest, or any relevant portion thereof, in a manner that best respects the spirit of these Rules; and/or (c) award the Prizes from among the compliant eligible Entries received prior to the discovery of the problem, in accordance with the winner selection criterion set forth herein.

7.7 Language. In the event of a discrepancy between the French and English versions of the Rules, the French version will prevail.

7.8 Residents of Quebec only. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
