CONTEST

Official Rules (the “Rules”)

 

1. CONTEST AND CONTEST PERIOD

The “MONTHLY DRAWS OF ST-HUBERT GIFT CARDS” Contest (the “Contest”) is held by Les Rôtisseries St-Hubert Ltée (the “Organizer”). The Contest begins on January 1, 2022 at 00 h 00 min 01 sec Eastern Time (ET) and ends on December 31, 2022 at 23 h 59 min 59 sec ET (the “Contest Period”). The clock used by the Organizer will be the official clock to determine the date and time of receipt of an Entry (as such term is defined below).

 

2. ELIGIBILITY

In order to be eligible to enter into the Contest, a person must meet the following criteria at the time of his or her entry into the Contest: he or she is a legal resident of Canada and has reached the legal age of majority in his or her province or territory of residence (a “Participant” or, collectively, the “Participants”).

Are excluded the employees, officers, directors, shareholders, agents, representatives or mandataries of the Organizer and those of its subsidiaries, related companies, franchisees, advertising and promotional agencies and suppliers of prizes, as well as the members of their immediate family (father, mother, sisters, brothers, children), legal or common-law spouse, and all individuals with whom these persons are domiciled, whether or not these persons are related to each other. 

 

3. HOW TO ENTER

There are two (2) ways of entering the Contest:

A. By Subscribing to the Organizer’s Newsletter

During the Contest Period, the Participant must subscribe to the Organizer’s newsletter, either (i) on the Organizer’s informational website (https://www.st-hubert.com/en/fanclub/newsletter.html); (ii) on the Organizer’s transactional website (https://order.st-hubert.com/); or (iii) on the Organizer’s mobile applications.

By doing so, the Participant will receive one (1) entry into the Ongoing Draw, as well as one (1) entry into each subsequent Draw, provided that the Participant continues to subscribe to the newsletter on each subsequent Draw Date.

A Draw is deemed to be “ongoing” until 23 h 59 min 59 sec ET on its Closing Date. See section 5 for Closing Dates and Draw Dates.

For the sake of clarity, for example, a Participant who subscribes to the Organizer’s newsletter on January 17, 2022 and who unsubscribes therefrom on June 20, 2022 will obtain one (1) entry to the Ongoing Draw, held on February 7, 2022 and one (1) entry to each of the Draws held on
March 7, 2022, April 4, 2022, May 2, 2022 and June 6, 2022, but will not obtain any entries to the July 4, 2022 Draw or to the subsequent Draws.

Participants having already subscribed to the Organizer’s newsletter before the start of the Contest Period shall automatically receive one (1) entry into each Draw, provided that they continue to subscribe to the newsletter on the Draw Date.

B. By Sending a Text to the Organizer

During the Contest Period, a Participant may write and submit a text to the Organizer in order to enter into the Contest. The text must be submitted in one of the following ways:

The Participant must explain, in five hundred (500) words, his or her interest in the Contest and the Organizer. The submitted text must be original (not copied) and must not violate any applicable laws, including any intellectual property applicable laws. The Participant must also provide an email address and a phone number where the Organizer may contact him or her.

Once the Participant’s text is received and analyzed, the Organizer will provide the Participant with one (1) entry into the Ongoing Draw and one (1) entry into each subsequent Draw.

Each entry obtained by subscribing to the newsletter or by sending a text to the Organizer constitutes an “Entry”.

Limit. There is a limit of one (1) Entry per Participant per Draw. For the sake of clarity and without limiting the generality of the foregoing, a Participant may obtain only one (1) Entry per Draw either by subscribing to the Organizer’s newsletter, irrespective of the email address used, or by submitting a written text. Mechanically reproduced, forged or altered Entries are void. The Organizer is not responsible for lost, late, undelivered or invalid Entries, which will be disqualified. All Entries become the exclusive property of the Organizer and will not be returned to the Participant.

Any attempt by a Participant to obtain more than one Entry per Draw, by using multiple email addresses, social media accounts, identities, registrations, logins, or any other methods will void that Participant’s Entries and that Participant may be disqualified at the Organizer’s sole discretion. Use of any automated system (including but not limited to, Entries submitted using any robot, script, macro, or other automated service) to enter is prohibited and will result in the disqualification of the Participant. In the event of a dispute as to the identity of any person who submitted an Entry by subscribing to the newsletter, the authorized account holder of the email address used to enter will be deemed to be the Participant. The “authorized account holder” is the natural person assigned to the email address by the internet access provider, the online service provider or other organization responsible for assigning the email address account. Selected Participants may be required to show proof of being the authorized account holder.

By entering the Contest, the Participant agrees to comply with these Rules.

 

4. PRIZES

A total of sixty (60) prizes will be available during the Contest Period, for a total value of six thousand Canadian dollars ($6,000 CAD) (the “Prizes”).

Each Prize consists of a gift card of the Organizer of a value of one hundred Canadian dollars ($100 CAD).

Under no circumstances will more than the stated number of Prizes be awarded.

 

5. DRAWS

There will be twelve (12) draws, each a “Draw” or, collectively, the “Draws”, which will take place once a month in accordance with the “Draw Schedule” below.

For each Draw, the Entries must be received before 23 h 59 min 59 sec ET on the “Closing Date”.

Each Draw will take place at around 12 h 00 ET on each “Draw Date” at the Organizer’s head office located at 199, Four Valley Drive, Vaughan, Ontario, L4K 0B8.

During each Draw, five (5) Entries will be randomly selected amongst all eligible Entries received before the Closing Date of that Draw, for a total of sixty (60) selected Entries.

Odds of winning the Prize depend on the number of eligible Entries received before the Closing Date of each Draw.

 

6. NOTIFICATION AND PRIZE AWARD

A Participant selected during a Draw will be notified by the Organizer, by email or by phone, within forty-eight (48) hours following the time of the Draw.

If the Organizer cannot contact the selected Participant for whatever reason, the Organizer reserves the right, in its discretion, to proceed to another draw amongst all eligible Entries received for the Draw, in order to try to award the Prize to another Participant, who will be subject to disqualification in the same manner.

To be declared a winner (a “Winner”), the selected Participant must, in addition to satisfying the Contest eligibility criteria, comply with these Rules and must:

  1. respond to the Organizer’s notification within forty-eight (48) hours from said notification. The Winner must provide all of the following information: the language in which he or she prefers to communicate, his or her given name, his or her family name and his or her complete mailing address for the sending of the Prize;
  2. correctly answer, without assistance of any kind, whether mechanical or otherwise, a mathematical skill-testing question; and
  3. sign a declaration and release of liability in connection with the Prize and acknowledge having read these Rules and undertake to comply with them. Such declaration must be returned to the Organizer within the forty-eight (48) hours following its sending to the selected Participant by the Organizer.

If the selected Participant cannot meet these requirements, he or she cannot be declared the winner of a Prize and the Organizer will apply the procedure to reselect a Participant, who will be subject to disqualification in the same manner.

If no winner is declared within sixteen (16) working days following the initial Draw, the Organizer reserves the right to cancel the Prize.

The Organizer cannot, under no circumstances, be held to award more than five (5) Prizes per Draw or award a Prize otherwise than in accordance with these Rules.

 

7. PRIZE DELIVERY

The Prize will be delivered to the Winner by regular mail within the seven (7) working days following the receipt of the duly completed declaration and release of liability.

 

8. PRIZE ACCEPTANCE

The Prize must be accepted as described in these Rules and cannot, under any circumstances, be, in whole or in part, transferred to another person, substituted for another prize or exchanged for money. 

 

9. SUBSTITUTION OF A PRIZE BY THE ORGANIZER

At any time and for any reason whatsoever, the Organizer reserves the right to substitute a Prize as described in these Rules with a prize of the same nature and of equivalent or greater monetary value, or, in its sole discretion, to provide the monetary value of the Prize indicated in these Rules.

 

10. GENERAL CONDITIONS

Personal Information. The Organizer and its authorized agents will collect, use, and disclose the personal information provided by the Participants as part of their Entry into the Contest for the purposes of managing and operating the Contest and for the fulfillment of the Prizes.

Review of the Declaration and Release of Liability. The declarations and releases of liability are subject to review by the Organizer. Any declaration and release of liability that is, as the case may be, incomplete, illegible or submitted late may be refused.

Consent. By entering into the Contest, the Winner authorizes the Organizer and its representatives to use, if needed, his or her name, place of residence and/or declaration relating to his or her Prize for publicity purposes, and this without any form of compensation or prior approval. 

Conduct of the Contest and Disqualification. The Organizer reserves the right, in its sole discretion, to cancel an Entry or to disqualify a Participant from the Contest and/or to exclude the Participant from any other future contest or promotion held by the Organizer (1) if the Participant fails to respect each of the conditions set out in these Rules; (2) if the Participant enters into or attempts to enter into this Contest by using means that are contrary to the these Rules or that are unfair towards the other Participants; or (3) if the Participant is suspected of having i) tampered directly or indirectly with the conduct of the Contest, ii) made a false statement regarding his or her entry, or iii) violated these Rules. In such case, the Organizer reserves the right, in its sole discretion, to carry out a new draw amongst the eligible entries received, subject to the same conditions.

Any attempt to deliberately damage any component related to the entry into or the administration of the Contest or to sabotage the legitimate conduct of the Contest constitutes a violation of civil and criminal laws. If such attempts were made, the Organizer reserves the right to deliver the Participant or any other person directly or indirectly related thereto to the competent judicial authorities and to obtain compensation under the law.

The Organizer's decisions regarding any aspect of the Contest are final. The Contest is subject to all applicable federal, provincial and municipal laws. The invalidity or unenforceability of one of the provisions of these Rules does not affect the validity or enforceability of any other provision contained herein. If any provision of the Rules is found to be invalid or otherwise unenforceable, these Rules will remain in effect and should be interpreted as if the non-applicable provision were not part of the present Rules. Paragraph headings are used for reference purposes only and should not affect the interpretation of the Rules.

Limitation of Liability. The Organizer and its subsidiaries, affiliated companies, advertising agencies, licensees, franchisees, partners, retailers, distributors and all other stakeholders related to the Contest, as well as their respective directors, administrators, shareholders, employees, agents, other representatives, successors and assigns (collectively the "Releasees") assume no liability and no obligation in connection with the Participant’s Entry into the Contest or with an attempt to enter into the Contest.

The Releasees are hereby released from any obligation and responsibility with regard to any damage or loss caused by any technical problem or defect likely to disrupt the Contest or the conduct thereof, and arising in particular, but not limited to, the malfunction of any computer component, any software or any communication line, the loss or absence of network communication or any faulty, incomplete or deleted transmission or download by any computer or any network. The Organizer in no way guarantees that all of the components related to the entry into and the administration of the Contest, including the Organizer’s website and/or mobile application, or any site related thereto, if applicable, will be accessible or functional without interruption during the Contest Period or that they will be free from any errors. The use of any component related to the entry into and the administration of the Contest is made at the Participant’s own risk. The Releasees shall bear no responsibility with regard to human, typographical, technical or computer errors, printing or network errors which may occur in the context of the administration of the Contest, of the download, of the counting or of the processing of the Entries, of the announcement of Prizes or in the documents related to the Contest. The Releasees shall bear no responsibility with regard any claim, action, damage, demand, means of action, cause of action, lawsuit, debt, duty, account, surety, agreement, guarantee, indemnity, contract or liability of any kind whatsoever, arising out of or related to the Entry or the attempt to enter into the Contest. The Releasees shall bear no responsibility for the subscribers’ subscription profiles or for any lost, incomplete, late, or misdirected declarations and releases of liability.

By accepting a Prize, the Winner releases the Releasees from any responsibility, obligation, claim, action, damage, demand, means of action, cause of action, lawsuit, debt, duty, account, surety, agreement, warranty, indemnity, contract or liability of any kind whatsoever arising from or related to the acceptance and/or use of the Prize.

Modification of the Contest. The Organizer reserves the right, in its sole discretion, to cancel, terminate, modify or suspend the Contest, in whole or in part, without notice or obligation, in the event that any occurrence or any human intervention manifested that could alter or influence the administration, security, impartiality or conduct of the Contest as provided for in these Rules, and this, subject to the approval of the Régie des alcools, des courses et des jeux (“Régie”) in Quebec, if required.

End of Participation in the Contest. Without limiting the generality of the foregoing, if the Contest, or any part thereof, is not capable of running as planned for any reason, including, but not limited to, due to a computer virus or bug, to tampering, unauthorized intervention, fraud, programming errors, or technical failures, which, according to the Organizer, in its sole discretion, corrupt or affect the administration, security, fairness, integrity or normal conduct of the Contest, the Organizer may, in its sole discretion, and subject only to the approval of the Régie for the residents of Quebec, cancel any suspect Entry and: (a) terminate the Contest, or any portion thereof; (b) modify or suspend the Contest, or any portion thereof, to solve the problem, and then resume the Contest, or any relevant portion thereof, in a manner that best respects the spirit of these Rules; and/or (c) award the Prizes from among the compliant eligible Entries received prior to the discovery of the problem, in accordance with the winner selection criteria set forth herein.

Language. In the event of a discrepancy between the French and English versions of these Rules, the French version will prevail.

Residents of Quebec only. Any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.


MINI-RULES

NO PURCHASE NECESSARY. “MONTHLY DRAWS OF ST-HUBERT GIFT CARDS” from January 1, 2022 at 00 h 00 min 01 sec ET to December 31, 2022 at 23 h 59 min 59 sec ET. For residents of Canada over the age of majority in their province or territory of residence. Limit: 1 entry par draw per person. Prizes: 60 St-Hubert gift cards of a value of $100 each awarded by way of 12 draws, that is one draw per month. Odds of winning depend on the total number of eligible entries received prior to the draws. Mathematical question required. Conditions and restrictions apply.
