(including its subsidiaries and divisions as well as the St-Hubert Foundation, hereinafter collectively referred to as "St-Hubert", "we", "us" or "our") we are resolutely committed to ensuring the confidentiality and security of the Personal Information (as defined below) of each of our partners.

This Privacy Notice ("Notice") applies to all personal information that may be collected through any of our websites, namely: st-hubert.com, order.st-hubert.com, lelarge.ca, suwong.ca, atable.ca, foreverchef.com (hereinafter collectively referred to as the " Websites") and any other Platform (as defined below) made available by St-Hubert, in the course of its business activities and that require interaction with you.

The purpose of this Notice is to provide you with a clear understanding of our practices when it comes to the protection of Personal Information.

By accessing St-Hubert Websites or Platform, you confirm that you accept the terms of this Notice and you agree that St-Hubert may process your Personal Information in accordance with the terms of this Notice.

We invite you to read it carefully and in its entirety to fully understand how your Personal Information is processed.

It is important to note that our Websites and Platform may contain links to other websites, which may be subject to separate privacy statements, notices or terms that are not governed by this Notice.

St-Hubert will not be responsible for the way these third parties may collect, use, disclose, obtain or otherwise process your Personal Information.

1. DEFINITIONS

A "Platform" means any software program or other technology made available by St-Hubert, or a third party retained by St-Hubert, including, but not limited to, the St-Hubert mobile application, the St-Hubert Foundation website, or the Wi-Fi service in certain of our restaurants.

"Personal Information " is information that directly or indirectly identifies you, including, but not limited to, your name, date of birth, mailing address, telephone number, personal email address, credit card information, and dietary preferences.

"Cookies" are small files that are sent to your browser from a web server and stored on your computer.

2. TYPE OF PERSONAL INFORMATION COLLECTED

The types of Personal Information collected by St-Hubert through our Websites and other Platforms include:

  • Your contact information: We collect your first name, last name, date of birth, personal email address, mailing address, and phone number;
  • Your payment information: We collect the payment method and the type of card used, if any;
  • Your personal preferences: We collect information about your food preferences, order history and consumption habits; and
  • Your resume: We collect information about your employment history and any other documents necessary to review your application.

St-Hubert may collect the types of Personal Information described above, in the following circumstances, notably:

  • when you place an order from one of our Websites or Platforms (including the purchase of gift cards);
  • when you subscribe to mailing lists, newsletters and email communications;
  • when you create a user account or use our Platforms;
  • when you respond to surveys given in restaurants or online;
  • when you participate in contests or promotions;
  • when you make a donation to the St-Hubert Foundation;
  • when you book a table at a restaurant;
  • when you apply for a job through one of our Websites or third party service provider;
  • when you contact St-Hubert to ask a question, submit a comment or make a complaint (customer service).

3. USE OF YOUR PERSONAL INFORMATION

Depending on the circumstances of the collection, St-Hubert will use your Personal Information as follows:

  • Online Ordering: Your Personal Information will be used to process your order, prepare it and deliver it to the correct location, if applicable;
  • Subscription to communications: We will use your Personal Information to send you promotional information, special offers, advertisements, marketing communications, and other company details;
  • User Account: Your Personal Information allows us to gather data on your personal preferences to better target promotional offers, it also allows us to analyze trends and usage patterns and compile information on the efficiency of deliveries and the operation of each of our locations with the goal of improving our systems;
  • Survey Responses: Survey responses will be used to improve our Websites and Platform, optimize our products and promotions, and improve experience at our restaurants;
  • Contest Entry and/or Promotion: Your Personal Information will be used to organize the contest, including notifying the winner and arranging prize allocation;
  • Donation to the St-Hubert Foundation: Your Personal Information will be used to process the transaction, receive the funds and issue a receipt, if applicable;
  • Table reservation: Your Personal Information will allow us to process your request, validate your identity and ensure that your reservation is respected;
  • Career: We will use your Personal Information in order to contact you and continue to process your application throughout the selection process; and
  • Communication with St-Hubert: To fulfill your requests, such as responding to your comments or requests, managing and completing transactions, as well as providing you with relevant information to improve your level of satisfaction with our services.

4. COOKIES

St-Hubert uses Cookies to record information about your use of our Websites or Platform.

In addition to improving the layout of our Websites and Platform, Cookies allow us to customize the browsing experience according to each user's individual preferences.

You can always modify your browser settings to prevent it from receiving Cookies or to notify you when a Cookie is being sent to you, to give you an opportunity to accept or decline the installation of Cookies.

However, if you choose not to accept Cookies from our Websites, you may not be able to take advantage of all of the features of that Website.

We may also work with third parties who use Cookies for marketing or advertising purposes.

In this context, these third parties may use Cookies to guide, optimize, and perform advertising activities based on your web browsing history, including your previous visits to that Website or your use of our Platform.

To measure the effectiveness of our advertising, these third parties may also use web beacons to understand certain information about your web browsing history.

If you wish, you can deactivate Google Analytics for the ads displayed.

5. DISCLOSURE OF PERSONAL INFORMATION

It is possible that some of your Personal Information may be disclosed to third parties other than St-Hubert.

Unless permitted by law without your consent or for the situation described below, if we intend to disclose your Personal Information to a third party, we will identify that third party and the purpose of the disclosure, and will obtain your consent prior to such disclosure.

a) Service Provider

Your Personal Information may be transferred, or otherwise made available to, third parties or affiliates who act as service providers on our behalf.

In particular, we use these providers for services such as hosting our Websites and Platform, sending our marketing communications and surveys, advertising services and data analysis or in connection with staff recruitment.

If we share your Personal Information with third-party service providers, we require that they keep it confidential and secure.

We also require that they use your Personal Information only for the specific purposes for which it was shared, in compliance with applicable privacy legislation.

b) Affiliate or our franchisees

St-Hubert is now one of the restaurant banners forming part of the affiliates, divisions or franchisees of Recipe Unlimited Company (the "RECIPE Group").

To this end, we may transmit your Personal Information to the RECIPE Group.

It is also possible that some of your Personal Information may be transmitted to our franchisees, in particular for the purpose of facilitating the order delivery system.

c) Sale of business

We may transfer the Personal Information we hold about you if it is part of a merger, acquisition, or sale, including in connection with bankruptcy or liquidation proceedings, or as part of a reorganization or change in control of our business or the RECIPE Group.

d) In accordance with the Law

Legally we are also allowed to provide your Personal Information without your consent, including in the following situations:

  • when the disclosure is necessary for the application of a law in Québec or elsewhere;
  • to comply with a request from public or government authorities, including from countries other than your country of residence;
  • to respond to a lawful request from a public body;
  • due to an emergency that endangers your life, health or security;
  • to protect the rights or property of our business;
  • in the context of a commercial transaction, under certain conditions; and
  • to protect our rights, the privacy of our information, our safety or our property and to allow us to pursue available legal remedies or limit the damages we may suffer in a particular situation.

e) Transfer outside of Quebec

Some of your Personal Information may be disclosed in another jurisdiction either in the rest of Canada, the United States or other countries.

St-Hubert will take all steps reasonably necessary to ensure the security of your Personal Information and its treatment in accordance with this Notice.

6. SECURITY SAFEGUARDS AND RETENTION OF INFORMATION

We have put in place reasonable administrative, physical and technical measures to protect the Personal Information we hold against unauthorized access, use, modification or disclosure.

In particular, we limit access to Personal Information to authorized employees and service providers only, and only to the extent necessary to perform their business duties.

We also use secure networks that benefit from enhanced protections, including password security systems, in accordance with industry standards.

Although we implement security measures to protect your Personal Information, no method of transmission or electronic storage is completely secure.

Therefore, we cannot guarantee absolute security. If you believe that the security of your Personal Information has been compromised, we encourage you to contact us immediately using the contact information in the "Contact Us " section.

7. UNSUBSCRIBE FROM OUR COMMUNICATIONS

If you no longer wish to receive communications from us, you can unsubscribe by following instructions in our emails.

8. YOUR RIGHTS

Upon presentation of a written request accompanied by proof of identity, you may access the Personal Information we hold about you and, if necessary, update it or request its rectification or deletion.

The Personal Information used to verify your identity will be used exclusively for this purpose.

In certain situations, you also have the following rights:

  • Withdraw your consent to the use or disclosure of your Personal Information;
  • Request a copy of the Personal Information we hold about you in a structured, commonly used technology format;
  • Where applicable, obtain information about any automated decision-making system using your Personal Information, as well as its possible impact on you; and
  • If applicable, request that Personal Information about you cease to be disseminated.

You also have the right to file a complaint with the Commission d'accès à l'information du Québec.

9. NOTICE TO PARENTS

St-Hubert is mindful of privacy issues surrounding Personal Information or minors and is committed to protecting their online privacy.

Therefore, no Personal Information should be provided by anyone under the age of 18 without the permission of a parent or legal guardian.

If a user under the age of 18 wishes to send us Personal Information, they must first provide the email address of a parent or legal guardian so that we can obtain the consent of a parent or legal guardian on behalf of the child.

No Personal Information from anyone under the age of 18 will be knowingly accepted without such written permission.

If your child has previously provided Personal Information, you may request to review that Personal Information for the purpose of modifying it or request that we delete it entirely from existing records by contacting us using the contact information provided in the "Contact Us" section.

We may update this Notice periodically to reflect changes to our privacy practices.

We encourage you to check this page regularly to ensure that you are aware of these changes.

We will indicate at the top of this Notice the date of its most recent update.
